MyCityCourier is a service offered by Lee Media Associates. Shipments accepted for MyCityCourier by its employees and agents (referred to collectively hereinafter as "MyCityCourier") are subject to the terms and conditions set out hereunder.

The MyCityCourier Shipment Bill is non-negotiable, and the shipper acknowledges that it has been prepared by the shipper or by MyCityCourier on behalf of the shipper.

The responsibility of MyCityCourier for a shipment accepted under a Shipment Bill ceases when the consignee acknowledges receipt of the shipment by affixing the signature on the "Proof of Delivery" copy and/or the Delivery Sheet.

By tendering materials for shipment via MyCityCourier, it is deemed that the shipper agrees to the terms and conditions stated herein.

The shipper warrants that he is the owner or the authorised agent of the owner of the goods transported hereunder, and that the shipper hereby accepts MyCityCourier's terms and conditions for itself and as agent for and on behalf of any other person having any interest in the shipment.

The shipper warrants that each article in the shipment is properly described on this Shipment Bill and it does not contravene the provisions of Canadian or international law and has not been declared by MyCityCourier to be unacceptable for transport as specified under Section 11 below and that the shipment is properly marked and addressed and packed to ensure safe handling.

The shipper shall be solely liable for all costs and expenses (which shall without limitations include Octroi, State and Local Taxes, and any similar taxes or imposts) related to the shipment and for costs incurred in either returning the shipment to the shipper or warehousing the shipment pending such return.

The shipper accepts the condition that the shipment is being carried by MyCityCourier from the point of tendering only up to the address shown on the Shipment Bill and that in case the shipment has to be rerouted/redirected/returned for any reason whatsoever, the shipper shall pay in advance all charges levied by MyCityCourier for such rerouting/redirection/return as per the normal schedule of charges of MyCityCourier as also any octroi, State/Local taxes, imposts etc. applicable thereon. MyCityCourier COURIER will hold such shipments at the destination mentioned on the SB for a maximum of 10 days from the date of the shipment without informing the shipper and the shipper hereby indemnifies "MyCityCourier" against any claim or liability.

Packing of the materials tendered for shipment is the responsibility of the shipper, including placement of such materials in containers supplied by "MyCityCourier", if any. Notwithstanding anything else in these Terms and Conditions, the shipper indemnifies "MyCityCourier" from any loss or claims arising from breakage or damage to the materials shipped.

"MyCityCourier" has the right, but not the obligation, to open or inspect any shipment.

Shipments shall be tendered to "MyCityCourier" in an "Open Condition" and shall by accepted only after an inspection of its contents by a "MyCityCourier" employee to ensure its conformity with these Terms and Conditions.

"MyCityCourier" reserves the right to refuse shipments under these Terms and Conditions without assigning any reason whatsoever.

Every shipment shall be charged by its chargeable weight as defined hereunder and not its actual weight.

The chargeable weight shall be the higher of:

1. the actual weight rounded off to the higher half kg. as per the category agreed to. (or)
2. the volume of weight similarly rounded off as in (a) above.

"MyCityCourier" shall have a lien on any goods shipped for all freight charges, Octroi, Federal/Provincial taxes, Advances or other charges of any kind arising out of transportation hereunder and may refuse to surrender possession of the goods until such charges are paid.

Without prejudice to Section 7 and Section 8, the liability of "MyCityCourier" for any loss or damage to the shipment (which terms shall include all documents or parcels consigned through "MyCityCourier") shall be the lowest of:

1. Ca$100 or
2. The amount of loss or damage to the document or parcel actually sustained, or
3. The actual value of the document or parcel as determined hereunder, without regard to the commercial utility or special value of the shipper:

In particular, "MyCityCourier" will not be liable for any loss of, or damage to the shipment or a delay in picking up or delivering the shipment if it is:

1. Due to acts of God, Force Majeure or any cause reasonably beyond the control of "MyCityCourier" or
2. Caused by :

The shipper indemnifies MyCityCourier against loss, damage, penalties action, proceedings etc., that may be instituted by any government officials in discharge of their official duties such as customs/taxation octroi inspection etc.

Not withstanding what is stated above, whilst MyCityCourier will endeavor to exercise its best efforts to provide expeditious delivery in accordance with its regular delivery schedules, MyCityCourier will not under any circumstances be liable for delay in pick up, transportation or delivery of any shipment, regardless of the cause of such delays.

Any claim must be brought by the shipper and delivered in writing to MyCityCourier within 30 days of the date of such acceptance. No claim can be made against MyCityCourier beyond this time limit.

No claim for loss or damage will be entertained until all transportation charges have been paid. The amount of any such claim will not be deducted from any transportation charges owed to MyCityCourier.

The invoice date begins the credit term cycle, and payment is due within ten days from the invoice date. Failure to keep your account current will result in your account being placed on a "credit card only" status. This status may impair your ability to use our service, your shipments may be delayed, and you may not be eligible for our discount program.

If the account number to be billed is not in good credit standing, the delivery may be held or stopped in transit until you make alternate payment arrangements.

1. Credit privileges will not be restored until all PAST DUE balances have been paid in full, in addition to all costs, fees and expenses incurred by MyCityCourier in collecting or attempting to collect such balances. NOTE: MyCityCourier may require establishment of electronic funds transfer as a prerequisite to credit restoration.
2. Customers requesting removal from "credit card only" status must contact our Accounts Receivable department
3. MyCityCourier may decline to restore credit privileges even if all costs, fees and expenses are paid. In the event of a prompt payment (on a "credit card only" status), you agree to be liable for all reasonable costs which may include - but are not limited to - attorneys' fees, collection agency fees and/or interest and court costs. NOTE: We do not provide consumer credit privileges.

To obtain credit privileges with MyCityCourier, you may be required to make bank draft arrangements for payment on PAST DUE accounts.

Except with the express agreement in writing of any authorised officer of MyCityCourier, MyCityCourier will not carry dangerous goods or materials:

1. Not permitted by the laws/rules/restrictions in force, and
2. Any items notified by MyCityCourier to be prohibited item.
3. Blood, urine, fluids, and other liquid diagnostic specimens containing infectious substances, are considered "Dangerous Goods". Non-infectious blood, urine, fluids, and other liquid diagnostic specimens must be packed to meet specific applicable local, provincial and federal laws.

   Shippers must also comply with all applicable local, provincial and federal laws governing packing, marking and labeling of shipments of blood and blood-related products regardless of whether they are infectious.

   Any package/shipment with an odor or any package that is wet or leaking will NOT be accepted for carriage. If a shipment damages or contaminates any property, the shipper will be held responsible and will reimburse Reliable Runners for any and/or all costs, fees and expenses incurred in connection with such damage or contamination.

MyCityCourier's Terms and Conditions are all the terms of the contract between the shipper and MyCityCourier.

The invalidity or unenforcability of any provisions shall not affect any other part of these Terms and Conditions.
